These terms apply to this website, marlysoft.com, and to the online services behind TillCaptain, PharmaCaptain and ClinicSmith, used in a web browser or through the Windows apps (together, “the services”). The services are provided by MarlySoft, operated by Zakarya Atef in Egypt (“MarlySoft”, “we”, “us”). By using them you accept these terms. If you use them for a business, you accept them for that business.
1. Accounts
- Keep your sign-in details to yourself, and turn on two-step sign-in if you can. You are responsible for what is done with your account.
- An administrator who creates a shop, pharmacy or clinic is responsible for the users they add and for the permissions they give them.
- Tell us at once at support@marlysoft.com if you think someone else is using your account.
2. Price
The services are currently free: there are no plans, subscriptions or payments. If we ever introduce paid plans, we will tell account holders in advance, and nothing will be charged without your agreement.
3. Your data
- The data your business enters belongs to your business. You allow us to store, process and back it up only to provide the services, as the privacy policies describe.
- You are responsible for having the right to enter it, including your customers' or patients' consent where the law requires it, and for following the rules that apply to your business, such as tax, pharmacy, medical-records and data-protection rules.
- You can download a backup of your business's data at any time and delete your account or close your business in the app.
4. Acceptable use
Do not use the services for anything unlawful; do not try to reach another business's data, to get around permissions or sign-in limits, or to disrupt or overload the services; and do not use them to send messages people have not agreed to receive.
5. Records, not professional advice
- The apps help you keep records. They do not give medical, pharmaceutical, tax or legal advice, and the decisions you make with them are yours.
- PharmaCaptain's drug list and prices come from a public dataset: check them against the official prices. Its interaction warnings come from rules your pharmacy writes; the sample rules that come with it must be checked against a clinical reference.
- ClinicSmith's interaction warnings come from rules your clinic writes, and it includes no drug database. It prepares insurance claim files but does not send them to insurers.
- Egyptian Tax Authority e-receipts and e-invoices need your own registration with the Tax Authority, and you are responsible for the documents you issue.
6. Availability and changes
We work to keep the services running and keep a backup of every business each night, but we cannot promise that they will always be available or free of errors. We may change, improve or remove features, and we may take the services offline briefly for maintenance.
7. No warranty and limits of liability
The services are provided “as is”, without warranties of any kind, to the extent the law allows. To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost business or lost data that a backup could have saved. Nothing in these terms limits liability that cannot be limited by law.
8. Ending
You can stop using the services at any time, delete your account or close your business in the app. We may suspend or close an account that breaks these terms or puts the services or other users at risk; where it is reasonable, we will warn you first.
9. Microsoft Store
If you install a Windows app from the Microsoft Store, the Store's own terms also apply to that download.
10. Law
These terms are governed by the laws of the Arab Republic of Egypt. This does not take away any rights that the consumer law of your own country gives you.
11. Changes to these terms
If these terms change, the new version will be published on this page with a new effective date. For important changes, we will tell account holders in advance where we can.
